Privacy Policy

This Privacy Policy (also referred to as the ā€˜Privacy Policyā€™) describes how Rakuten Fintech Vietnam Co., Ltd. (ā€œwe,ā€ ā€œus,ā€ ā€œour,ā€ ā€œRFVā€) collects, uses, shares, and protects (collectively referred to ā€˜processingā€™ or ā€˜processā€™) personal information (ā€œPersonal Informationā€) in connection with your use RFVā€™s website. We are a subsidiary of Rakuten Card Co., Ltd., one of Japan’s largest credit card firms

1. Principal of Personal Information Processing

  • Personal Information shall be processed lawfully, and in a transparent manner in relation to the data subject. Collection, processing, transfer, and use of personal data in an illegal way is strictly prohibited.
  • Processing of Personal Information only where this is strictly necessary for legal and regulatory purposes, or for legitimate organizational purposes.
  • RFV will only collect, process, transfer, and use the Personal Information provided by parties within the scope of laws, regulations, and business requirements, and will take appropriate and reasonable measures to handle and use the Personal Information within the necessary and reasonable scope.
  • Respecting data subject right in relation to their personal information.
  • Processing in a manner that ensures appropriate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, by using appropriate technical or organizational measures.

2. Information We Collect

We collect, process, and use information about you when you:

  • Access on our company website and other websites owned or controlled by the RFV
  • Access on software applications made available by us for use on or through computers and mobile devices (ā€œAppsā€)
  • Email us expressing an interest in working with us.
  • Apply for a job (whether solicited or non-solicited)
  • Enter and participate in RFVā€™s recruitment process and when participating in job interviews and/or tests.
  • Contact us for support, submit questions, and/or request information.
  • Provide feedback.

We collect certain Personal Information when you submit or provide it to us directly. When you interact with us on website, we also automatically collect information about you through the use of log processes, cookies, location-identifying technologies, and other tracking technologies. The certain Personal Information is collected about you from third parties, such as when you connect through a third-party service or business partner site.

  • The types of information we collect about you may include personal information of the following types:
    Identifiers that you provide us directly, such as your first and last name, address, date of birth.
  • Contact information such as postal address, email address, and/or phone number
  • Information contained in employee files, including employment history, evaluations, and information collected during the application and hiring process.
  • Identifiers collected through accessing website, such as unique online or device identifiers, internet protocol (IP) address, cookies, device or session IDs, and information regarding your system configuration (operating system and version), network, and connected hardware (e.g., computer or mobile device and carrier)
  • Internet and other Network Activity, such as your browsing and search history and your interactions with our site and Services, including:
    • URLs of the pages you visit.
    • date and time stamps associated with such browsing, searches, and clicks.
    • click stream data, meaning the page by page clicks that you make as you navigate through our Services, including the web page visited before you came to our website.
  • Other information that you provide to us including but not limited to government-issued photo ID, photographs of you, proof of address documentation, such as a lease or rental agreement information.
  • Geolocation, to the extent you have configured your device to share such information with us, and locale preferences for your use of the Services.
  • Sensory-related information, such as audio recordings of your voice to the extent you call us, as permitted under applicable law.
  • Inferences drawn about you and your likely preferences, characteristics, behavior, and attitudes from any information we collect about you.

If you are a business customer, we may collect Information relating to your beneficial owners, users, employees, contractors, suppliers, and business partners. Where you provide us with personal information relating to others (such as beneficial owners of a business), you warrant that you have their consent to share the information, are entitled to provide the information for the purposes stated in this Privacy Policy, and you will inform the third party that you have provided the information to us.
If you send us a question, request information, or give us feedback, we may ask you for information to help us respond to your issue, such as your geographical location, professional and demographic information, industry, and preferred contact method.

3. How We Use the Information We Collect

We may use the Personal Information for the following purpose:

3.1 For Recruitment Process

  • Support recruitment process including contact candidate to discuss on applied position or job opportunities, send periodical recruitment advertisements and marketing activities, update the interview process, results of test and interview to candidates.
  • Operate and innovate RFVā€™s Recruitment Process, improve Candidate Experience.
  • We also use Candidateā€™s Information to send an email or other updated news of Rakuten Fintech Vietnam.

3.2 To Protect You, Others, and our Business

We may use collected Personal Information to assess risk and to investigate and limit fraud, spam, and other malicious online activities in our Services, and to improve our security measures. We may also use collected information to assert our legal rights or to defend our legal rights against third parties.

3.3 To Comply with Applicable Laws

We may use information we collect about you to enable us to comply with applicable laws, rules, regulations, and judicial authorities in each geographical region in which we operate.

3.4 Cookies and Other Similar Technologies.

Our site uses cookies and other similar technology. Cookies are text files that web servers send to your computer for recordkeeping and other purposes. The site may use session cookies (which expire when you close your browser) and persistent cookies (that remain on your computer after you close your browser) until you delete them or they expire. RFV does not share a consumerā€™s Personal Information outside of RFV except in certain circumstances.

Disclosure to Our Service Providers

We may share all categories of your collected personal information as necessary in order to accomplish the business purpose described above with our third-party service providers (which may include affiliates and subsidiaries of our parent company, Rakuten Card Co., Ltd and Rakuten Group) who perform various business operations, solely for our benefit or on our behalf, under our instructions and in compliance with appropriate contractual, technical, and organizational security measures to protect your data from unauthorized use, retention, or disclosure.
These third parties are contractually obligated to secure and refrain from disclosing your information that we disclose or otherwise entrust to them. When third parties are given access to Personal Information, we will take appropriate contractual, technical and organizational measures designed to ensure that Personal Information is processed only to the extent that such processing is necessary, consistent with this Privacy Policy, and in accordance with applicable law.

Disclosure for Legal Purposes

We may share the Personal Information we collect, including Personal Information, to the extent permitted by applicable law, (i) in response to subpoenas or other legal processes or if, in our good faith opinion, such disclosure is required or permitted by law without a specific disclosure; (ii) at the request of governmental authorities conducting an investigation; (iii) to enforce our terms and conditions or other policies applicable to our Services; and (iv) to protect the rights, property, life, health, security, and safety of RFV or any third party.

In Relation to Business Asset Transfers

We may share the information we collect, including personal information, with any third party in connection with, or during confidential negotiations of, any proposed or actual merger, purchase, sale (including a liquidation, realization, foreclosure, or repossession) or any other type of acquisition of all or any portion of RFV assets, conveyance or transfer of all or a portion of our business to another company. In such event, the acquiring company would be contractually required to use your collected information in accordance with this Privacy Policy and applicable law or to provide prior notice to you of any new or materially changed practices.
Please note that these third parties may be in other countries where the laws on processing personal information may be more or less stringent than in your jurisdiction. When we disclose your personal information overseas, we will take all reasonable measures to ensure that your information is held, managed, and accessed in accordance with appropriate standards for the handling of Personal Information.
In addition to the above listed disclosures, we may also share aggregated or de-identified information that cannot reasonably be used by recipients to identify you.

5. Transferring Personal Data outside Vietnam

By providing us with your personal data, you understand and agree that your personal data may be transferred outside the territory of Vietnam.
In the event we transfer your personal data abroad, we will take steps to ensure appropriate and necessary levels of protection are maintained to preserve the security and integrity of your personal information as required by the applicable law of Vietnam. We will ensure that the receiving party can provide protection standards equivalent to the protection standards as per the law for the transferred personal data.

Third Party Sites

This Privacy Policy does not address, and we are not responsible for, the privacy practices of any third parties, including those that operate sites to which this site links. Including a link on our site does not imply that we or our affiliates endorse the practices of the linked site. When you access our site, you may be directed to other websites or applications that are beyond our control. We may also allow third-party websites or applications to link to our site or use Session Trackers. We are not responsible for the privacy practices of any third parties or the content of linked websites and applications. We encourage you to read the applicable privacy policies and terms and conditions of such parties, websites, and applications. This Privacy Policy only applies to this site.

Do Not Track

RFV does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to monitor and review new technologies and will modify this Privacy Policy accordingly in the event of a change.

Retention of Data

Candidateā€™s Information shall be kept in confidential in RFVā€™s servers and stored until he/she requires to delete his/her Candidateā€™s Information.

Information Security

To the extent of our ability, RFV commits to applying appropriate technical & security measures to protect Candidateā€™s Information. However, in situations that are out of our control, we shall not ensure to prevent Candidateā€™s Information from all loss and damage or unauthorized/ illegal access to Candidateā€™s information (ā€œDamageā€). In case of the Damage hereof happens, we shall be responsible for informing the matter to the authorities to carry out the investigation promptly and inform Candidate, BUT not be responsible in any form for any claim, dispute or damage arising from or related to Damage.

8. Changes to This Privacy Policy

This Privacy Policy is current as of the effective date set forth below. RFV reserves the right to change this Privacy Policy from time to time consistent with applicable privacy laws and principles. If we make changes to this Privacy Policy, we will notify you by revising the date on this Privacy Policy. In some cases, we may provide you with additional notice (such as adding a statement to the homepages of our website or sending you an email notification).
